Posted By david_nwpa 3 months, 1 week ago in StyleSame-sex couples from Wisconsin who go to California to marry could find themselves facing criminal charges when they return home. A little known Wisconsin law makes it a criminal offense to enter into a marriage outside the state if that marriage were illegal in Wisconsin.

This law is in serious need of reform. The intent of the legislature was to prevent underage minors from marrying. However, the language is too broad, and should be narrowly focused on youth, rather than on gay couples. Why should it be a criminal offense for gay couples to wed in another state? Something tells me that the "full faith and credit" clause of the US Constitution will come into play if this ever goes to trial. The people of Wisconsin should be outraged!

LMFAO. Not just Wisconsin liberals, but that mean, divisive, regressive guy from Illinois too. That hate mongering Obama who is not for gay marriage either. He panders and rabidly generalizes as well, but somehow he gets a pass from the far, far left. The shame of it all!

Milwaukee is more liberal than Boston, San Francisco, Chicago and Detroit? Wow, I will have to mark that down. Just because Wisconsin has a ban on marriage equality does not make it the Dems fault. Not all Dems can be as liberal and accepting as Tammy Baldwin, an openly lesbian Rep from Wisconsin. Your blanket statement is pure pandering and a rabid generalization.

"Milwaukee is more liberal than Boston, San Francisco, Chicago and Detroit?"
Learn your state capitals, David. Milwaukee is NOT the capital of Wisconsin. MADISON is the capital. But, while you mention it, yes, Milwaukee is a Democrat controlled city and county.
"Your blanket statement is pure pandering and a rabid generalization."
That's what I've been pointing out for a long time about your rabid generalizations of conservatives while pandering to your alleged base. Democrats carried statewide elections in Wisconsin that year, yet they voted to ban gay marriage.
For all your hatred of conservatives on this issue, you continually miss your true enemy. As I've said before, myself and many conservatives I know have voted in favor of gay marriage. Might serve you well to take note of it.

No, The people from California should be outraged! For they voted down gay marriage in the general election - YET the california judicial thought they KNEW better than the people of the State who they are suppose to represent and overturned how they VOTED! so now its headed back to the ballot in november.

The people of California have a Supreme Court that did its job properly. Their constitution was upheld regardless of the whims of the voters. The electorate can pass all the laws they like, but if they fail Constitutional muster, they should be nullified, which is precisely what the court did.

We as a nation, and each of the states has a REPRESENTATIVE democracy, and the elected representatives of the people have TWICE passed bills permitting gay marriage. The court is on board, obviously, and the idiot actor said that the court needed to decide in his vetoes of above mentioned bills, and that he would support the decision of the court. This means that the ENTIRE GOVERNMENT of California supports the right of any two adults to marry each other. If the people have a problem here, they need a constitutional convention, not a ballot measure.

I fail to see how any state can make it illegal for you to leave there and do something that is legal where you go, whether it is legal where you start out or not. The intent of keeping people from running away and getting married is irrelevant. It is illegal to gamble in many places, does that mean that I could, conceivably, be prosecuted for going to Atlantic City for a weekend? Absurd. This law probably would not withstand a challenge in state court, and definitely would not in federal court.

It would be nice if they did, but whether or not they do, you have stood up in front of witnesses and declared your mutual and permanent love with the sanction of the government where you are. I predict that there will only be one, ultimately unsuccessful, prosecution of adult gays under this silly law.

i read this story and had to just say did they not think about why they had to leave the state that they were living in to get married! Come on now i understand why they wanted to get married ,they love each other and they want to live together for the rest of there life's. like a normal couple usually does ,but were they not living together before ? just no peices of paper saying that they are bonded together for life ,okay i am not trying to be funny or anything but i could have wrote that out for you and would not have charged a thing. I hope you did not go and get married so the goverment would recognize you and that the people in your town would take notice ,because if you did your marriage will never work. you broke the law in your rush and irrational decision to get married . you should have thought this one through a little better and maybe your marriage would'nt have started off on such a ruff ground.

You want an amendment that allows marriage equality nationwide? Brilliant idea. We should start a pro-gay marriage amendment. That would once and for all end any further discussion about gays and lesbians being allowed to wed. Great suggestion!

I don't think this is necessary, any more that the ERA was necessary for women to have equal rights. It is so difficult and time consuming to amend the Constitution, and I believe that before this can happen, the Federal courts will nullify the Defense of Marriage act and the various state amendments and laws, and require all states to recognize each other's marriages under the interstate commerce clause.
